Political tensions flared in West Bengal after the ruling Trinamool Congress (TMC) conceded defeat to the Bharatiya Janata Party (BJP), and the state’s Chief Minister (CM), Mamata Banerjee on Tuesday refused to step down from her post. Her remarks drew fierce flak and calls for dismissal from senior advocate Mahesh Jethmalani.

Jethmalani, in an interview, termed Banerjee’s stance ‘unpardonable’ and a direct affront to democratic norms, asserting that her continuation in office after the certification of election results undermines constitutional propriety. 

“Insult to democratic system, Banerjee should be dismissed”: Jethmalani

Jethmalani, in an exclusive interview, contended that once election results are certified by the Election Commission of India (ECI), the incumbent Chief Minister ceases to hold legitimate authority. He remarked, “This is an insult to the democratic system. The Governor must not wait. Banerjee should be dismissed,” adding that her refusal to step down voluntarily leaves no room for a graceful exit. 

Continuing his statements, he further said, “The Governor has both the authority and responsibility to act decisively. If she insists on clinging to power, she must be removed unceremoniously,” suggesting that even enforcement agencies could be deployed if the need may be. 

Banerjee remains defiant

On Tuesday, after TMC lost to BJP in the West Bengal Assembly Elections 2026, Banerjee said while addressing the media-persons, “I have not lost. I will not go to Raj Bhavan or resign,” adding that nearly 100 seats had been stolen from her party in the polls. 

Jethmalani suggests legal recourse

Jethmalani, in response to Banerjee’s allegations, advised her to seek legal recourse if she possesses credible evidence. He suggested that she file election petitions in court rather than making sweeping public claims. He said, “If there is proof, let it be tested in a court of law.”

Senior BJP leaders echo similar sentiments

Senior BJP leaders, including Assam CM Himanta Biswa Sarma, echoed similar sentiments. He said, “The country does not function on personal whims. If she does not resign, she will inevitably be removed,” underscoring that constitutional processes must prevail. 

Notably, West Bengal Assembly’s term is slated to conclude on May 7, and has placed the unfolding standoff on the Governor’s next move.
